Welcome to MyTown Cabs. By downloading, installing, or using the MyTown Cabs mobile application ("Application"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Application.

1. About the Service

MyTown Cabs is a ride-hailing platform that connects users ("Riders") with local drivers ("Drivers") for point-to-point transportation. The Application is operated by MyTown Cabs ("Service Provider", "we", "us", "our").

We act solely as an intermediary platform. We do not provide transportation services directly. Drivers may operate independently or through third-party arrangements.

2. Eligibility

You must be at least 18 years of age to use this Application.
You must provide a valid Indian mobile phone number for OTP verification.
You must provide accurate personal information during registration.

3. Account Registration and OTP Authentication

User login and verification is conducted through OTP (One-Time Password) authentication using Firebase Authentication. By registering, you agree to:

Provide a valid mobile number that belongs to you.
Maintain the confidentiality of your registered mobile number and verification codes.
Accept responsibility for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.

4. Booking and Ride Requests

When you select pickup and drop-off locations, the Application displays available vehicle options (Mini, Sedan, SUV) with estimated fares. By confirming a booking:

Your ride details (pickup/drop locations, vehicle type, estimated fare) are shared with our dispatch team.
A 4-digit OTP is generated for ride verification. Share this OTP only with your assigned driver at pickup.
A driver will be assigned and will contact you directly to confirm the ride and arrival details.
The driver must verify your OTP before starting the trip for safety purposes.

5. WhatsApp Communication

By booking a ride through the Application, you agree that:

Booking details (including your name, phone number, pickup/drop locations, vehicle type, and estimated fare) may be shared with drivers or operators through communication platforms such as WhatsApp for ride coordination purposes.
You may receive ride updates, confirmations, or support messages via WhatsApp or SMS.
You can opt out of promotional messages by contacting our support.

6. Fare Estimates and Pricing

The fare shown in the Application is an estimated price calculated based on:

Vehicle type selected (Mini, Sedan, or SUV)
Distance between pickup and drop-off locations
Estimated trip duration
A base fare and per-kilometer/per-minute rates

Actual charges may vary depending on traffic conditions, route changes, waiting time, tolls, luggage, night charges, detours, or other applicable factors. The final fare may be discussed and confirmed directly with the driver.

All rides are currently settled via cash payment directly to the driver at the end of the trip.

7. Cancellation Policy

You may cancel a ride at any time before the trip is completed.
Frequent cancellations may result in temporary restrictions on your account.
If a driver has already started traveling to your pickup location, a cancellation fee may apply as communicated at the time of cancellation.
Drivers may also cancel or release a ride. In such cases, your ride request will be reassigned to another available driver.

8. Driver Responsibility and Liability

Drivers providing transportation services may operate independently or through third-party arrangements. The Service Provider:

Acts as a platform connecting Riders with available Drivers.
Is not responsible for driver behavior, delays, cancellations, route deviations, disputes, accidents, or service quality beyond reasonable operational support.
Does not guarantee the availability of drivers at all times or in all locations.
Reserves the right to approve or reject driver registrations based on internal verification processes.

9. Location Data and GPS

The Application requires access to your device's location services to function properly. By using the Application, you consent to:

Collection of your real-time location for ride booking, route calculation, and driver assignment.
Sharing your pickup and drop-off coordinates with assigned drivers and our dispatch team.
Storage of ride-related location data for service improvement and dispute resolution.
Location permission is mandatory for using the ride-booking features of the Application.

10. Push Notifications

We may send you push notifications regarding ride updates, promotions, and service announcements. You can manage notification preferences through your device settings.

11. User Conduct

As a user of the Application, you agree to:

Treat drivers with respect and courtesy.
Provide accurate pickup and drop-off locations.
Be present at the pickup location at the agreed time.
Pay the agreed fare to the driver promptly at the end of the trip.
Not use the Application for any unlawful, fraudulent, or harmful purpose.
Not share your account credentials or OTP with unauthorized persons.
Not damage or misuse the driver's vehicle during the ride.

12. Safety

Always verify the driver's identity and vehicle details before boarding.
Share your ride OTP only with the assigned driver.
Share your trip details with a trusted contact for added safety.
In case of an emergency during a ride, contact local emergency services immediately.

13. Intellectual Property

All content, logos, trademarks, and software in the Application are owned by or licensed to MyTown Cabs. You may not copy, modify, distribute, or create derivative works without our prior written consent.

14. Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

You violate any of these Terms.
You engage in fraudulent, abusive, or illegal activity.
You repeatedly cancel rides without valid reason.
You provide false or misleading information during registration.
Your behavior poses a risk to drivers, other users, or our operations.

15. Limitation of Liability

To the maximum extent permitted by law:

The Application is provided "as is" without warranties of any kind.
We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Application or transportation services.
We do not guarantee uninterrupted, error-free, or secure operation of the Application.
Our total liability shall not exceed the fare of the most recent ride booked through the Application.

16. Indemnification

You agree to indemnify and hold harmless MyTown Cabs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Application or violation of these Terms.

17. Privacy

Your use of the Application is also governed by our Privacy Policy. By using the Application, you consent to the collection, use, and storage of your personal data as described therein.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the Application or on our website. Continued use of the Application after changes constitutes your acceptance of the revised Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or the use of the Application shall be subject to the exclusive jurisdiction of the courts in Karnataka, India.
